The following shall apply to any and all construction, improvement, alteration or maintenance fo any structure, any change to the exterior of any structure and to grading, excavation, tree removal, landscaping , or any other change to the grounds of a single-family detached home-site within Broad Creek Marina Village. Fines and cease of construction will ensue if violated.

START OF CONSTRUCTION: No lot cleaning or placement of portable toilets will be permitted until formal written consent of the AC has been granted and all required governmental permits are obtained. It is required that contractors post all permits using weather-proofing material during the duration of the project. Emergency phone numbers should be clearly indicated.

PORTABLE TOILETS: Prior to commencing work a portalb etoilet must be placed on the job site and must face away from the street and be covered with white lattice.

CONSTRUCTION TRAFFIC: All construction traffic sshall access the community thrugh the designated entrance. The contractor must register with the Homeowners Association a complete list of subcontractors and other employees with permission to tenter the community. No construction personnel is permitted after construction hours or on non-working days.

CONSTRUCTION HOURS & NOISE CONTROL: The construction working hours are from 7:00 am to 6:00 pm, Monday through saturday. No work is permitted on Sundays or nationally recognized holidays except in the event of an emergency. Equipment should not be started before contruction working hours and motor driven equipemnt must be equipped with proper mufflers. Music cannot be heard from off the property.

SITE CLEAN-UP: Construction sites must be maintained in a neat and orderly fashion. EAch resident under construction will be required to have at least one (1) trash dumpster on site over the course of construction. Dumpsters will be emptied on a regular basis. The builder is responsible for all trash.

CLEARING: Only plants, vegetation and trees directly within the planned structure, roof overhangs or driveway shall be removed with the permission of the AC. Any plants, vegetation or trees uprooted or cut down shall be removed within a practical amount of time, not to exceed five (5) working days.

CONSTRUCTION DAMAGE: It is the intent to minimize damage caused by contruction - any damage to the community infrastructure caused by any builder, contractor or subcontractor shall be repaired or replaced at their expense.

CONSTRUCTION SPILLAGE: Operators of vehicles are required to see that they do no spill any materials. If spillage of a load occurs, operators are to remove the debris/spillage accordingly and at their expense.

CONSTRUCTION DEPOSIT: Prior to the commencement of any construction activities on a lot, a construction deposit shall be made in an account determined by the AC. In the event that any fines are imposed by the Association, damages are caused to community infracstructure as a result of the applicant's construction activities, the Association may draw on the construction deposit to pay for such fines or the cost for repairing any such damage. The applicant shall deposit such funds necessary to replensh the account within ten days of receiving notice from the Association.
